Joint communiqué between the republic of Indonesia and the United Nations transitional administration in East Timor (UNTAET)
 
The government of the Republic of Indonesia and the United Nations Transitional Administration in East Timor (UNTAET):

Recalling Decision no. V/MPR/1999 of the People's Consultative Assembly of the Republic of Indonesia of 19 October 1999 concerning East Timor;

Recalling also the United Nations Security Council Resolution 1272 (1999) of 25 October 1999 concerning the establishment of UNTAET,

Expressing satisfaction with the level of cooperation between the Government of the Republic of Indonesia and UNTAET,

Stressing the importance of the establishment and development of a long term and stable relationship between Indonesia and East Timor and believing that such relations will contribute to regional peace, security and stability,

Emphasizing the need of reconciliation among East Timorese,

Recognizing the importance of promoting democracy, respect for human rights and fundamental freedom,


Have reached the following understanding:

 
1 The establishment of the Representative Office of the Republic of Indonesia to the United Nations Transitional Administration in East Timor which shell enjoy the privileges and immunities as provided for in the Vienna Convention on Diplomatic Relations of 1961 and the Vienna Convention on Consular Relations of 1963;
 
2 The establishment of the UNTAET Jakarta Office and UNTAET Liaison Office in Kupang which shell enjoy the privileges and immunities provided for in the Convention on the Privileges and Immunities of the United Nations of 1946;
 
3 Discussions to resolve issues arising from the transfer of authority in East Timor to the United Nations, inter alia, assets and claims, return of and protection of cultural artifacts and private property, archives and records pertaining to East Timor, the status of refugees, land border demarcation and maritime delimitation and state pensions of East Timorese who were Indonesian civil servants;
 
4 The maintenance of educational and scholarship opportunities for East Timorese students in Indonesian institutions of higher learning;
 
5 Cooperation in economic, trade, investment. socio-cultural and legal fields;
 
6 The promotion of democratic governance, respect for human rights and fundamental freedom for the benefit of the people of the Republic of Indonesia and East Timor;
 
7 The establishment of a border regime in Timor island that permits the passage of goods and people between East Timor and Republic of Indonesia and which allows unimpeded access for people and goods on a special corridor between the Oecussi enclave of East Timor and the other districts of East Timor;
 
8 The conclusion of arrangements to facilitate financial and trade relations and investment between Indonesia and East Timor;
 
9 The establishment and improvement of air, land, and sea transportation links between Indonesia and East Timor;
 
10 The establishment of telecommunications and postal links between Indonesia and East Timor;
 
11 The intention to conclude a memorandum of understanding on the provision of mutual assistance in legal, judicial and human rights related matters. Pending the conclusion of such memorandum of understanding, the Attorney General of the Republic of Indonesia and UNTAET shell facilitate access of the respective authorities to information and testimony relevant to an investigation, prosecution or trial, including records, archives, data and documents that are related to such proceedings.
 
12 The establishment of an Indonesia-UNTAET Joint Commission at the appropriate level with sub-commissions including on business, environment, trade, health, culture, education and human rights, to enhance cooperation between the people of Indonesia and East Timor.
